Terms of Service

These Terms of Service ("Terms") govern access to and use of TheDiogen, a software platform provided by TheDiogen ("we," "us," "our") for advertising agencies ("Agency," "you"). By creating an account or using TheDiogen, you agree to these Terms.
1. The service
TheDiogen connects to advertising accounts (including Google Ads and Meta Ads) that you or your clients authorize, reads spend and performance data through those platforms' official APIs, and helps you reconcile that spend against budgets and calculate amounts to invoice your clients. TheDiogen is currently offered as a private beta, and functionality may change as the product develops.
2. Accounts and access
Access to TheDiogen during the beta period requires a valid access code. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when registering.
3. Authorization to connect third-party accounts
When you connect a Google Ads, Meta Ads, or other advertising account through TheDiogen, you confirm that you are authorized to grant TheDiogen access to that account's data, whether the account belongs to your agency or to a client who has given you permission to do so on their behalf. You may revoke this access at any time through the relevant platform's account settings or by contacting us.
4. Acceptable use
You agree not to misuse TheDiogen, including by attempting to access accounts or data you are not authorized to access, interfering with the service's operation, or using the service for any unlawful purpose.
5. Data handling
Our collection and use of data, including advertising account data accessed through connected platforms, is described in our Privacy Policy, which forms part of these Terms.
6. Beta service disclaimer
TheDiogen is currently in private beta. The service is provided "as is" during this period, without warranties of any kind, express or implied. Reconciliation calculations and invoice amounts generated by TheDiogen are intended as a tool to assist your agency's own review process, not as a substitute for your own verification before invoicing clients.
7. Limitation of liability
To the maximum extent permitted by law, TheDiogen and its operator shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to lost revenue or invoicing errors, except where such liability cannot be excluded by law.
8. Termination
You may stop using TheDiogen and close your account at any time by contacting us. We may suspend or terminate access to the service if these Terms are violated, or as needed to operate the beta program.
9. Changes to these Terms
We may update these Terms as the product evolves. Material changes will be reflected on this page with an updated date above.
